In recent years, investing in most real estate projects has generated very handsome returns. Other than the office markets in some high-tech areas, the returns on real estate have far exceeded the returns on all other investment categories. There are a variety of reasons why real estate, in general, has performed above other investment types, one of which is the unusually low interest rates. These investments included a variety of real estate types, such as single-family housing, multi-family office buildings, hotels, raw land, assisted living facilities and industrial properties. Investments were made by direct equity mezzanine funding, mezz equity and mortgages. All the investments were made with outside managers.

The task of code drafters is facilitated when they can proceed from the assumption that a single paradigm governs the lawyers role-either a paradigm encapsulating a theory of behavior (how lawyers ordinarily act) or a paradigm encapsulating a normative ideal (how lawyers should act). When code drafters rely upon multiple paradigms (for example, lawyers should act as clients alter egos and as officers of the court), inconsistent regulatory mandates can result, and lawyers may become confused about their functions. The ABAs 1908 Canons of Ethics, which prevailed in most American jurisdictions throughout the early twentieth century, suffered from an emphasis on inconsistent ideals.1 The bar was in a state of disagreement about lawyers roles and lawyers had no point of reference for determining how to act.2 Therefore, when the ABA adopted the first concrete professional code in 1969,3 it became important for the drafters to identify an over-arching theory. By emphasizing the lawyers place in the adversarial system, the 1969 code served a forceful unifying and educational function.4 Nevertheless, an ethics codes overemphasis on a single paradigm can lead to undesirable results. It tends to produce idealized rules that either rest on counter-factual assumptions or impose obligations on lawyers that are so inconsistent with their personal incentives that violations become routine. In modern times, an exclusive focus on the adversarial ethic seems less important than in 1969 because lawyers have developed a shared sense of core obligations to clients and of the part lawyers play in the legal system. The recent history of lawyer regulation reflects a desire on the part of the bar to fine-tune the basic message of the 1969 code-to recognize more nuances than, perhaps, a single image of lawyers can accommodate.5 The task of drafting professional rules is complicated by the fact that the public perception of the bar is not unitary. Society views lawyers in many different, and sometimes inconsistent, ways. These multiple conceptions influence code drafters. In practice, the modern legal ethics codes incorporate a number of “images” of lawyers as bases, or catalysts, for disciplinary rules. Relying on these images has consequences for how the codes treat lawyers and, as a theoretical matter, for how the rules should be drafted.

Speaking of cap ex, some on Wall Street are optimistic about Advanced Micro Devices Inc.s (AMD) plans to reduce costs from its manufacturing process next year in order to remain competitive with Intel. But one market research analyst said the Sunnyvale, Calif.-based MPU maker could do even more. IDCs Shane Rau said while AMD focuses on dispelling the megahertz myth through its True Performance Initiative, it could better use the money to shift its Athlon processors over to 0.13 micron faster, or pull in its 2003 plan to utilize silicon-on-insulator technology. Finding a truer gauge of microprocessor performance would have more resonance if it came from an industry-wide consortium involving Intel, AMD, Via, Transmeta and others, Rau added.

In a rash moment, in bleak midwinter, I booked myself yet another session, the latest in my countless attempts to come to terms with air travel. It is very boring to have a flying disorder. But it is probably even more boring to live with someone with a flying disorder. For my latest appointment I went to an Australian hypnotherapist called Shareen Lovegrove - with no great expectations, I have to admit, of being induced to fly anywhere. Shareen did not ask me to picture a “happy” place, however. She explained rationally that I was in charge of my own destiny, that my phobia was misplaced and that airline pilots had a vested interest in getting the plane to its destination and also had no desire to be squashed to an irrevocable pulp. I had heard this before, but it hadnt ever had the desired effect. Until now. Two weeks later I had committed myself to a weeks holiday in St Lucia (flying time 10 hours, 50 minutes including a stopover in Antigua). The long days of winter are clearly the optimum time for a non-flyer to be persuaded to fly because, along with everyone else, we have lost the will to live anyway. So with the aid of drink, drugs and Shareens calm logic on my Walkman, I managed the flight. And in economy class, too. I was still in a bit of a haze when we arrived at our hotel, the Royal St Lucian, and quickly passed into a coma-like slumber. The following morning, I realised why I had put myself through the ordeal. I opened the French windows and there, in full technicolor, was the “happy” place of my imaginings: deserted, white sandy beach, palm trees, the glittering, deep Caribbean Sea. St Lucia is a small island, manufactured by huge volcanic eruptions, that created vertiginous mountains that rise up directly from the sea. It is green, lush and dramatic, with large swathes of its interior covered with rainforest. The temperature hardly varies from 27C throughout the year, but the heat is deflected by constant, cooling trade winds.

Edward Barry Tegeler, 60, pleaded guilty on Friday in 7th District Court. Private investors who use stockbrokers to advise them on their equity investments have always had problems in the performance of their portfolio. From this week, their efforts will be made easier by the joint launch between the FT-SE and the Association of Private Client Investment Managers and Stockbrokers (APCIMS) of three new indices, providing a yardstick against which to compare their portfolios performance. They will also provide a comparison basis from which investors can review their asset allocation and structure of their portfolios together with their stockbroker or fund manager. Finally, the indices aim to provide an industry-wide benchmark for assessing the performance of discretionary fund managers. Michael Read, head of fund management at Greig Middleton, and an APCIMS board member, says: “Private investors and trustees have long been waiting for readily accessible, highly visible and easily understandable benchmarks. “There is a real need for such measurement tools and I think investors will be pleased that information which has previously been available to institutional investors is now available to them cheaply and conveniently.” The three indices are based to the key needs of investors: for income, capital growth and a balanced portfolio. A survey of the model portfolios will be carried out quarterly and used to determine the weightings of the asset classes within each of the three indices. Although the survey will be conducted quarterly, the index weightings will be based on the annualised portfolio weightings, in order to maintain continuity. In determining asset allocation, the performance of UK equities will be measured by reference to the FT-SE All-Share index. Foreign equity performance will be measured by reference to the FT/Standard Poors All World Index, without UK stocks. Bonds and cash will be assessed by reference to FT-SE Gilts All-Stocks index. A sample of leading discretionary private client fund managers showed the average allocations for model portfolios changed according to whether they were income or growth producing, or balanced. Indices will be calculated by FT-SE International and both capital and total returns for private investors will be published. The underlying return calculations will assume the private investor purchases and holds the underlying stocks. Weightings will be adjusted at the end of each month to maintain the chosen weightings for the asset classes within each private investor index. Back histories will also be created, starting from 1986, in order to give a rough-and-ready reckoner of indication of historical performance. Experts at APCIMS who collaborated in drawing up the indices agree that they may not provide a perfect model for all clients. Michael Read at Greig Middleton points out: “For all sorts of reasons the construction of a clients portfolio of investments and its performance is unlikely to exactly mirror the indices. “Our benchmarks are not perfect. For example, they do not allow for a clients requirements not to invest in certain sectors of the market, nor do they take into account the capital gains tax constraints. None the less, they will be a very useful guide and will provide a good discipline for the industry. “In the main, we find our clients at Greg Middleton want to participate in growth as the market rises as well as obtaining a reasonable and growing income. “They recognise that we are not superhuman and do not expect us to achieve `top dollar appreciation all the time. They want safety and responsible investment management. “As a by-product, {these indices} will show over time how badly bank and building society deposits have served savers”

> Modeling firm Eqecat Inc. has unveiled its Offshore Energy Model to help insurers manage and quantify their exposure in the offshore energy market. The model is expected to be released in the second quarter of 2007. It covers a range of risk in the Gulf of Mexico for oil and gas platforms, pipelines and other offshore infrastructure, and can account for the removal of debris, business interruption and contingent business interruption.
Solid Terrain Modeling (STM), of Fillmore, California, has completed 17 detailed models for the National Geographic Society. In some of the models, GPS provided key data that supported the accuracy of the final products. The large, full-color, 3-D scale models of sites on Earth and Mars, and of Hurricane Floyd, are now on display at the Societys museum, Explorers Hall, in Washington, D.C. To produce a model, STM uses a matched set of satellite digital elevation and photometric data for the selected geographic area. First, the digital elevation data is used to control STMs highly-calibrated cutting machine as it carves the model into the plastic foam. Then, the photometric data is used to control STMS printing machine as it applies the satellite imagery. GPS provided orbit determination onboard the 2000 space shuttle flight that carried the Shuttle Radar Topography Mission (SRTM) that captured the image of Patagonia used to create the model of Patagonia shown here (bottom). In effect, GPS created all the SRTM digital elevation models (DEMs) for the mission. In the case of the Mount Everest model (shown at top above), after the DEM was created, GPS data georeferenced the photogrammetric mapping and provided current elevations for the mountain.

A friend of mine recently showed me a story in our local newspaper about a popular entertainer at childrens birthday parties. He charges $300 for a half-hour show, and parents are happy to pay — which the author attributed to the “fundamental desperation of suburban parents.” Two things about this newspaper story upset my friend. First was the fact that parents would pay $300 for a half-hour of entertainment at a preschoolers birthday party (not counting the moon bounce and the cotton-candy machine). Second was the assumption that everyone does it. “Not in my neighborhood,” says my friend. As the mother of twins, my friend is particularly concerned about keeping parties under control. She makes it a point to have a single celebration for both of her daughters, and to limit the guest list.
Also joining in on the fun were some very special celebrity guests, many of whom also wore pajamas from The Childrens Place as they walked the red carpet. Pajama partiers included Constance Marie from The George Lopez Show (who read one of her favorite stories to the children), Jonathan Silverman and his fiancee Jennifer Finnegan of CBS Close to Home (who held her own against many of the children in the video game challenge), Carlos Bernard of FOXs 24 (who kicked off the karaoke contest), former Miss America Leanza Cornett (who read one of her favorite childrens books), and Danica McKellar. It was presented by The Childrens Place West Coast Vice President of Stores, Paula Lyons to Karineh Moradian, Director of Childrens Services for the CA*AZ*NV Chapter of Starlight Starbright Childrens Foundation. The $10,000 will be used by Starlight Starbright towards hosting other fun-filled events for the children in the new year. The days activities included a magic show, arts and crafts, a pretty princess booth, a bubble show, face painting, a video game challenge, and karaoke. All of the children also left with a $50 gift certificate to The Childrens Place so they can snuggle up to even more great fashions just in time for the New Year.

In addition, Beaton says bleaching paper with chlorine uses vast amounts of water. It takes 10.15 gallons of water to produce a six-and-a-half-ounce booklet, says Beaton. [Using a chlorine-free alternative] uses less than a half gallon per booklet. Chlorine also has side effects that are seen across the globe, sometimes in places nowhere near the paper mills that produced them. According to Greenpeace, these pollutants have been found in the Arctic, where polar bears, whales and marine mammals have elevated chlorine levels.
Authorities believe an undissolved bubble of chlorine gas burst at the surface near where they were swimming. In the second incident on July 20, a total of 13 people in Menno, S.D–a lifeguard, a maintenance worker and 11 children–were hospitalized after inhaling chlorine gas at the Menno Swimming Pool. The leak came from the pools equipment room during routine maintenance. Everyone was treated and released, but doctors said at least one child may have long-term problems due to the exposure. The third incident took place July 28 in Simi Valley, Calif. Two children were hospitalized after being exposed to chlorine gas at a YMCA pool. Fire officials said YMCA staffers were conducting routine maintenance when chlorine and acid were mistakenly mixed together and released into the water. Nineteen people complained of eye, ear or throat irritation or difficulty breathing. A 10-year-old girl and an 11-year-old boy were taken to Simi Valley Hospital for treatment and later released.

There have been many milestones in model design throughout the history of R/C model flying- To choose the most important models-those that had the biggest impact on the hobby– would be a difficult task. I can think of a number of models in many categories that would qualify as “new and important” developments. What really makes the Big Guff a milestone is not the model itself. It was a combination of the model, a reliable radio system and the Goods efforts to demonstrate them for the purpose of obtaining dedicated, hobby– related radio frequencies. If not for the Good brothers, we would not have received our first radio channel (27.225MHz) as soon as we did: March 1952. It is good to know that historians have acknowledged the importance of the Big Guff and have given it a place in the Smithsonians Air and Space Museum in Washington, D.C. (A replica of the Big Guff hangs in the AMA Museum in Muncie, IN.) In the 1940s and early 1950s, most R/C models were no more than controlled, free-flight models, and we could fly only one model at a time on our single radio channel. Generally, the only control was a sequenced rudder (right, neutral, left, neutral, etc.) controlled via a push-button on the transmitter. Throttle control (when it was used) was obtained with dual ignition points. Remember, the glow plug didnt come along until 1947.

Measuring instruments of the future will have to be up to six times more accurate than they are today and must live outside the PC. Thats what Keithley Instruments (Cleveland) found when it surveyed 301 process and test engineers recently. “Engineers in plants and design labs all see making rapid, repeatable measurements as a critical technology,” says Michael Minneman of Keithley. As for speed, measurement systems must collect their data-without sacrificing resolution or sensitivity-without slowing the production line. Though only 23% of the engineers surveyed require more than 1000 readings/sec, 30.5% say they will soon need that speed, and 12% expect they will need speeds as high as 10,000 readings/sec. At these levels, its clear that computer-controlled devices will do most of the measuring.

Aqua and taupe make this bath anything but ordinary. Fresh, cooling hues, inspired by sandy beaches and azure waters, rejuvenated this sunny space. The redo came after Hurricane Ivan pounced on the home of Connie and Rodney Handle in Gulf Breeze, Florida. While the couple was repairing the damage, they made other improvements too. Among them-a more spacious master bath. With designer Cheryl Kees Clendenon of Pensacola, the Randies chose luscious aqua to be the star attraction of the space. Through a high horizontal window, the walk-in corner shower offers a picture-perfect view of boats docked behind the house. The shower, like the floor and tub surround, is surfaced in creamy beige travertine. A tall pane of opaque glass, situated in the wall above the tub, gives the shower more light. Plantation shutters on the windows offer privacy.
I realised I didnt want to be a spaceman when I entered the Mir space station. As the hatch closed behind me, I knew that spending the next six months in this pressurised bath tub would stretch my right stuff to infinity - and beyond. Luckily, I could walk right through Mirs claustrophobic cabins and exit by the back door. It was a brilliantly sunny, but bitterly cold March day and our guide enthusiastically introduced us to the pleasures of cosmonaut training. There was the giant centrifuge machine where trainees would be spun in a chair to many times the force of gravity in an attempt to eject the contents of their stomachs. People who have done this say that they literally see a red mist descend as blood is forced into their eye sockets. Then there was the water tank where prospective cosmonauts wearing the thick mittens of a mock space suit would be given a set of spanners and told to fix a broken air lock - underwater, while working with a limited supply of oxygen. Its the sort of task that might nowadays be made into a television game show. Having the right stuff is, of course, the essential prerequisite of going into space. Yuri Gagarin, the first man to orbit the Earth, must have had heaps of it. Unfortunately, we were given only a sanitised description of his rather exuberant life at Star City. We saw the immaculately tidy office he is supposed to have left behind, with the clock permanently fixed at the time he died in an air disaster. But his drinks cabinet was strictly out of bounds.

Construction of new homes, primarily in La Quinta, continues to dominate the Coachella Valley construction industry.With La Quinta issuing permits for 103 homes valued at $18,020,040, the valley toted up $58,789,335 in building valuations during November, a slight increase of .07 percent over last November.Again, La Quinta stood at the top of the chart, followed by Palm Desert with a $16,452,036 November total.In all, permits for 196 homes totaling $42,079,097 in valuations were issued.
WASHINGTON — Construction of new homes and apartments plunged by 17.6 percent in March, the biggest decline in 14 years and another possible indication that rising interest rates are beginning to take a toll on the economy. Meanwhile, wholesale inflation shot up 0.7 percent as energy prices soared. The Commerce Department reported Tuesday that builders started construction on new homes and apartments at a seasonally adjusted annual rate of 1.84 million units in March, down from 2.23 million units in February. “This is a bit of a shocker,” said David Seiders, chief economist for the National Association of Home Builders. “But I dont think this represents a fundamental downshift in the housing market. There were special factors behind it.”

FEAR of exploitation and degradation is what inspired Congress in 1872 to set aside 2.2 million acres in three states to preserve the unique volcanic region known as Yellowstone as the worlds first national park. President Ulysses S. Grant signed the measure declaring that the sensitive area, with its roaring geysers and bubbling mud, would forever be set apart “for the benefit and enjoyment of the people.” Sadly, the short shrift given to Yellowstone, that grand old patriarch of parks, is symptomatic of a neglectful policy being applied to our national treasures across the board. At a time of war and tax cuts and huge deficits, something has to give. Regardless of cell-phone ban details, many corporations are recognizing that a real risk exists concerning cell phone use and, in an effort to avoid costly litigation stemming from an accident caused by one of their own distracted drivers, are re-evaluating their own phone-use policies. As part of its own recommendation for companies to consider a ban on cell phone use while driving, the California Association of Employers has even put a sample cell phone policy on their website.
The news is sobering. Driving while talking on a cell phone is the same as driving drunk. The number of new single-family homes under construction in El Paso County fell for the second straight month in February, but industry officials arent fretting yet. Construction began last month on 584 single-family homes - down 12 percent from the 664 homes started in February 1999. MIAMI — PHD Audiophile Sound Systems, maker of hand-crafted Italian car audio speakers, announced at the 2005 Consumer Electronics Show plans to enter the U.S. market with a complete line of speaker products that features the Esacoil, the worlds first ever six-voice coil subwoofer. According to Renner, the Esacoil combines the advantages of a conventional subwoofer with the benefit of using isodynamic/electrostatic (fast response) in an all-in-one solution. Made with die-cast aluminum, the Esacoil is faster than other conventional speakers due to the six voice coils, the magnetic power engine and its light cone, which helps provide a more natural response given the lower momentum and a lower inertia. The Esacoil can be considered a two in one speaker. It is a woofer plus midrange all in one because it can reproduce in the lowest frequency, yet it has a fast response of 29.01 Hz, due to the six coils and special light cone, explains Daniele Baiano, PHD Head Engineer. The six voice coils have been made with thinner copper wire compared to other speakers of the same size since the total power is divided into six. Thinner wire provides a more detailed sound quality and linear response.

The newly merged Michigan Association of Chiropractors (MAC) has awarded the Chiropractor of the Year award to two doctors - Drs. Christophe Dean and Thomas Klapp, who were honored for their outstanding commitment and leadership in the advancement of chiropractic in Michigan. The dual award marks the recent successful merger of the Michigan Chiropractic Association (MCA) and the Michigan Chiropractic Society (MCS). Dr. Dean, a graduate of Palmer College of Chiropractic, has been a chiropractor since 1975. He has served on the Michigan Chiropractic Council (MCC) board of directors and was elected MCCs president in 2004. Dr. Klapp graduated cum laude from Life Chiropractic College in 1979.
